Terms and Conditions Agreement

This document details the terms and conditions for all corporate sailing events ("Events") organized by Team Paradise Sailing (TPS) for the contracting corporate entity ("the Corporation"). These terms become effective upon TPS's receipt of the Corporation's initial deposit.

1. Booking and Payment

1.1. Reservations must be made at least thirty (30) days in advance and require a deposit of 50% to confirm the event date.

1.2. The remaining balance is due no later than fourteen (15) days before the scheduled event.

1.3. The preferred payment method is electronic funds transfer (EFT). Payments made by credit card will incur a 5% processing fee. Please get in touch with TPS for EFT instructions.

2. Cancellations and Weather Policy

2.1. A full refund minus any transaction fees will be issued if the corporation cancels more than fifteen (15) days before the event.

2.2. If the corporation cancels within the period of fourteen (14) days to eight (8) days of the event, the corporation will incur a cancellation fee equal to 50% of the total event cost, minus any transaction fees. This only applies if the final deposit has been paid in full.

2.3. If the corporation cancels within the period of seven (7) days to five (5) days before the Event Day (Day-1), the corporation will have the opportunity to reschedule the event within twelve (12) months by mutual agreement.

2.4. TPS reserves the right to cancel or modify the event due to unsafe conditions, including but not limited to:

• If the National Hurricane Center issues a Tropical Storm or Hurricane Watch/Warning

• Sustained wind speed exceeding 20 knots

• Thunderstorms, tropical storms, or hurricanes

• Force majeure or other "Acts of God"

2.4.1. In such instances, TPS will offer the corporation the opportunity to reschedule the event within twelve (12) months by mutual agreement.

2.5. Following the cancellation of any such storm advisories, TPS requires a fourteen (14) day window to safely remobilize its fleet before rescheduling events.

3. Program Overview and Expectations

3.1. TPS offers the following corporate sailing formats:

• Four-hour Corporate Regatta (up to three races)

• Seven-hour Racing Excursion

• Custom-tailored experience, agreed upon in advance.

3.2. Time is of the essence! The event schedule (timeline) is posted in the official Sailing Instructions (SI). On-time arrival at our venue is essential. Failure to do so may result in a reduction of the number of races in the series. If less than 2.5 hours of sailing time remains, the event may be converted to an excursion. Isolated corporate team members who arrive late may be left behind. 

3.3. To save time on the day of the event, all participants are expected to sign the online Corporate Participation Waiver, no less than twenty-four (24) hours before the event:

4. Boats and Participation

4.1. Each sailboat will include a TPS-assigned instructor/skipper.

4.2. Maximum capacity per boat is as follows:

• Sonars and J/24s: Four (4) corporate team members.

• Flying Scots: Three (3) corporate team members.

4.3. A list of all participants and proposed team assignments is expected by the corporation, no less than twenty-four (24) hours before the event.

4.4. When forming teams, corporations are encouraged to consider body size and prior sailing experience.

4.5. TPS reserves the right to modify team configurations at any time for safety or operational purposes.

5. Safety and Wind Guidelines

5.1. Sailing is a weather-sensitive activity. Guest involvement is determined by wind speed:

• 5–10 knots: Guests may perform most sailing tasks

• 10–15 knots: Moderate limitations apply

• 15–20 knots: Jib sail is removed; instructor/skipper helms the boat.

• Above 20 knots: Sailing is canceled

5.2. TPS encourages hands-on participation. Tasks may include:

• Helming the boat

• Adjusting sails and balancing the boat

• Navigating, timing starts, setting bearings, calling overlaps, and race strategy
